Unless otherwise agreed by the parties, mediation fees are divided equally among the participating parties.
Billing
Mediation time is billed on an hourly basis. Billable time may include reasonable preparation and review of mediation statements and other materials, pre-mediation conferences when necessary, time spent conducting the mediation, and agreed-upon post-mediation work. A “party” generally means the participants represented by the same counsel or a self-represented participant.

Cancellation & Rescheduling Policy
Because mediation dates are reserved exclusively for the parties, cancellations or rescheduling within five (5) business days of the scheduled mediation may be subject to a cancellation fee. Unless otherwise agreed, mediation fees and applicable cancellation charges will be allocated equally among the parties.

Before you book the day.
Does the mediator decide the case?
No. Michael serves as a neutral. The parties control the outcome. If they do not resolve the dispute, the case continues in court. Mediation is a chance to evaluate risk and choose a resolution — not a substitute for a ruling.
Is the mediation confidential?
Mediation communications are confidential under Florida law, subject to the exceptions in the Mediation Confidentiality and Privilege Act. What is said in a private caucus is not shared with the other side unless that party authorizes it.
Who should attend?
Counsel, and the people with authority to settle. When insurance is involved, the carrier representative with authority should be present or immediately available. Parties may attend in person or, when arranged in advance, by video.
Where do sessions take place?
Broadstone Mediation is based in Jacksonville Beach, Florida. We provide mediation services throughout the State of Florida, with mediations conducted conveniently and securely via Zoom. In-person mediations may also be available upon request.
What should we send beforehand?
A short confidential submission: the essential facts, the legal and practical issues, and what a workable resolution could look like. Send what the other side should see to them. Send what should stay in caucus only to the mediator.
What kinds of disputes do you mediate?
Circuit civil matters, including personal injury and negligence, business and commercial disputes, insurance coverage and claims, employment, real estate and property, and other general civil cases pending in Florida circuit courts.
How are fees set?
Two-party mediations are $225 per hour, per party. Three-party mediations are $175 per hour, per party. For four or more parties, please contact Broadstone Mediation for rates. Unless otherwise agreed, fees are divided equally among the participating parties. Half-day mediations have a two-hour minimum, and full-day mediations have a three-hour minimum. Cancellations or rescheduling within five business days of the scheduled mediation may be subject to a cancellation fee.
Does contacting the office create an attorney-client relationship?
No. Michael J. Kelley is a Florida attorney and a mediator. In a mediation he serves as a neutral. A scheduling request does not make him your lawyer, and nothing on this site is legal advice.
